There are times when we must rest to replenish ourselves. And, if we must surrender in our individual cases, it should not mean that we surrender the war leaving others in harm's way without weapons and supplies. WJFA are fraud victims that have either won their war, or, lost, both carry much knowledge to pass on to others in need.

Fraud Victims Helping Each Other

 

WJFA is about fraud victims paying it forward to help others in harm's way.

Knowing how we lost our case can be used to help others understand how to win their own.

Keeping the public ignorant of crimes assists perpetrators. Personally, this means that we are required to know more about injustices than just what happened to us.

As an example, you may not know much of anything about the current trend in mortgage fraud. Yet, if you happen upon a victim, you can refer them to this web site and the support group.

We must become informed, or in the least, have sufficient information to network with others who do have information.

As former fraud victims, we know too well the stress and fear you are feeling in addition to feeling overwhelmed by the prospect of having to be your own attorney regarding the fraud against you.

These pages are techniques and strategies from crime victims that already went through the process. It is their perspective and there is no guarantee that it will work for you or that it can work. It is solely the opinion of the victims and not intended to be legal advice.

But it is a good launching pad to give you a perspective of what to look for, and or, what to discuss with your attorney.

Interrogatories

Most fraud victims, who have had to undo the crime against them in the civil court, have opted to use the strategy of interrogatories rather than the high cost of depositions. Interrogatories are a set of questions done during discovery, that either side may ask the opposing side and the recipient is required to respond.

Unclean Hands

The Unclean Hands Doctrine at its most simplest is the law that requires you to be devoid of any wrong doing when filing a lawsuit against another. We give you an example.

Collateral Estoppel

Basically, it's the defendant saying to the plaintiff, "Look, you big dumber, you pulled the exact same garbage on someone else and lost, so, don't go there with me."

Res Judicata

The best way to remember Res Judicata is the classic Steely Dan song Do It Again. "You go back Jack, do it again, wheel keep on turning..." You get the idea?   If that has happened in your case, then look at the res judicata doctrine. Think of it as the same cast of characters in the same play that may have a new title

Real Estate Fraud

Real estate fraud ranges from the theft of a home by use of foreclosure scams, or transfer of title by use of forged grant deeds. Undoing the frauds typically involves filing a Quiet Title action. It's a process where you seek the court's order transferring ownership back to you.

RICO

RICO would apply to a fraud victim. Remember, RICO is not a one-size-fits-all solution.
